Media Giant Hosting ("The Company") agrees to furnish services to the Subscriber, subject to the following Terms of Service (TOS). Use of Media Giant Hosting's services constitutes acceptance and agreement to Media Giant Hosting’s TOS and Acceptable Use Policy (AUP). All provisions of this contract are subject to the TOS and AUP of Media Giant Hosting. The AUP may be modified at any time at the discretion of the Company. Subscriber agrees that changes to the AUP do not constitute grounds for early termination or non-payment.

This Agreement shall be construed in accordance with the laws of the State of Florida, County of Saint Lucie. Any disputes will be resolved in this jurisdiction.

1. Disclosure to Law Enforcement

Media Giant Hosting may disclose any subscriber information, including assigned IPs, account history, and usage details, to law enforcement upon written request without further notification to the Subscriber. Media Giant Hosting reserves the right to terminate any service that violates applicable laws or policies.

2. Service Rates

Subscriber acknowledges that service rates and charges are communicated clearly on the website. All recurring charges will auto-renew unless otherwise stated. Media Giant Hosting reserves the right to adjust rates or charges prospectively.

3. Payments

Service setup is dependent upon payment receipt. Recurring services are automatically renewed, with payments due on the anniversary of the billing period. This applies to all accounts and services provided by Media Giant Hosting.

4. Payments and Fees

Declined credit card payments incur a $10 fee.
Services unpaid 7 days past due are subject to interruption and a $50 reconnect fee.
Accounts referred to collections are subject to fees between $50–$100.

5. Refund Policy

Media Giant Hosting offers a 30-day money-back guarantee to ensure customer satisfaction. To request a refund:

Open a support ticket with the Customer Support Team.
Request termination of the service and a full refund within 30 days of service activation.

Refund requests received after the 30-day period will not be honored. On the 31st day, all payments become non-refundable, including recurring charges.

6. Failure to Pay

Failure to pay on time may result in service suspension or termination. This does not relieve the Subscriber of the obligation to pay accrued charges, interest, and collection fees.

7. Account Cancellation

Account cancellations must be requested at least 30 days before the end of the current service term. To cancel:

Login to the Client Area at https://www.mediagianthosting.com/clientarea.
Navigate to "My Products & Services."
Select the service to cancel and submit a "Request Cancellation."

Confirmation will be sent within two business days.

8. Service Interruptions

Media Giant Hosting is not liable for damages caused by service interruptions beyond its control. Liability for negligence will not exceed the amount paid by the Subscriber during the service period.

9. New Domain Accounts

New hosting accounts with domain registration are typically set up within 3–5 business days. Transfers may require additional time. Handling fees may apply for domain registration by Media Giant Hosting.

10. Support Boundaries

Media Giant Hosting provides 24/7 technical support for server-related issues. Support excludes:

Application-specific issues (e.g., programming, HTML).
End-user customer support for resellers.

11. SPAM and Unsolicited Email

Media Giant Hosting has a zero-tolerance SPAM policy. Violations may result in:

First violation: $250 fine and account review.
Second violation: $500 fine and account termination.

Customers are encouraged to adopt similar policies for their clients.

12. Network Usage

IP Address Ownership: IP addresses are assigned at Media Giant Hosting's discretion and remain its property.
Bandwidth and Disk Usage: Usage exceeding agreed limits may incur additional charges or service suspension.

13. Security

Users are prohibited from attempting to breach network security. Violations will be investigated and may result in termination and legal action.

14. Service Suspension

Media Giant Hosting reserves the right to suspend or terminate accounts involved in policy violations. Service time lost due to suspensions will not be credited.

15. Indemnification

Subscriber agrees to indemnify Media Giant Hosting for any losses or claims resulting from AUP or TOS violations.

16. Miscellaneous Provisions

Media Giant Hosting is not liable for data loss or service interruptions.
Subscriber is responsible for content stored on their hosting account.
Media Giant Hosting reserves the right to amend its policies at any time.
